GENERAL

You can consult here the provisions governing the use of the site www.passetonbillet.fr. You declare below to enter into a direct contractual relationship with the Passetonbillet platform. All that will relate to your account, your personal data and the technical means deployed, is specified in said regulations, hereinafter designated by the "General Conditions of Use governing the Platform".


GENERAL CONDITIONS OF USE GOVERNING THE PLATFORM

Legal validity

These General Conditions of Use governing the Platform have been established by Passetonbillet LTD, whose registered office is at 63 Coram Street, WC1N 1HD, United Kingdom, and which is registered with the Chamber of Commerce under number 12002310. When using the Platform, you conclude a contract with the company Passetonbillet (hereinafter referred to as the “Ticket Agreement”), as “User”. The provisions following the title "Ticket Agreement" do not apply to the company Passetonbillet, which reserves the right to modify these General Conditions of Use governing the Platform. By using the services offered on the Passetonbillet Platform, you agree to comply with the most recent version of the present governing this Platform. You are required to consent to any modification to the agreement of said Platform when using it.

Platform Service

Through its online digital platform (hereinafter referred to as the “Platform”), Passetonbillet LTD offers services allowing you to buy and / or resell electronic tickets for trips and events, such as train tickets, concerts, parties and festivals (hereinafter referred to as the “Platform Service”).

Registration

You can use the Platform Service by logging in and registering using your email address or Facebook account. You are required to carefully enter all your personal details and use only one Passetonbillet account.

Confidentiality

Passetonbillet LTD ensures the protection of your personal data under the data protection law (Wbp) and (from May 2018) of the general data protection directive (AVG). Passetonbillet will only use the confidential contact details you have given it for the purpose of allowing access to the Platform service and communicating with you on this subject. Strictly personal use

The service offered on the Passetonbillet Platform is reserved for strictly personal use. We strongly discourage commercial resellers and commercial parties from buying or reselling on the Platform. Scripts, (partially) automated software, or any other means of gaining priority over purchases are prohibited. Otherwise, these practices will result in the (permanent) blocking of the User.

Disclaimer

Passetonbillet LTD can not be held responsible for damage caused by having used the service offered on its Platform or the Platform, unless such damage is intentional, or results from proven negligence or '' characterized recklessness. Although the company Passetonbillet LTD, with a view to its proper functioning, takes all the necessary measures to ensure that its Platform is secure, it cannot in any case guarantee that the service offered on the Platform or that the content of that - these may be free from any malfunction or inaccuracy. Responsibility

The company Passetonbillet LTD is not responsible for any damage which you could undergo and which would result from your use of the service of Platform or the Platform, like losses incurred by the Buyer or the Seller following the Modification of an event (also referred to here as the "Modification of the Event"), unless this damage has occurred intentionally, as a result of gross negligence or willful recklessness.

Payment service

Payment services for the User officiating on Passetonbillet are (in some cases) provided by MangoPay and subject to the MangoPay framework payment service contract, which includes the MangoPay Terms of Service. By agreeing to this Ticket Agreement or by continuing to operate as a Passetonbillet User, you agree to be bound by the MangoPay General Conditions of Use, which may occasionally be modified by MangoPay . Therefore, you agree to provide Passetonbillet with precise and complete information about you and your activity. Also, you authorize Passetonbillet to share this information as well as that concerning the transactions carried out via the payment solution provided by MangoPay.

Non-conforming use

As a sine qua non condition for the use of the services offered on the Platform, you declare that you do not enter information, data or content through the Platform that would be contrary to law or legislation. Furthermore, you declare that you do not: pretend to establish unauthorized relations with a natural person or an entity; want to forcibly enter the secure and protected parts of the site; intend to transmit viruses, spam, spam, email chains, unsolicited promotional or advertising materials of any kind; intend to examine, scan or test the vulnerability of the Platform or any other system or network linked to it, or even act in a manner that defeats our security or authentication measures *; use scripts, (partially) automated programs or any other method to gain priority over purchases; If the company Passetonbillet should have doubts about the respect of these obligations, the company is entitled to refuse you (definitively) access to the Platform and its services, and this with immediate effect.

TICKET CONVENTION

Ticket Convention

When you resell an electronic ticket on the Platform, or buy a ticket from a third party, a contract is established between you (as a User) and Passetonbillet. The specific legal entity with which you conclude the contact relating to the electronic ticket (s) depends on the location of the event at the origin of the issuance of the electronic ticket (s) ). Passetonbillet reserves the right to modify said contact relating to electronic ticket (s). If you offer a (new) electronic ticket for purchase or sale, and the Ticket Agreement has changed, you agree to automatically take note of the most recent version of said contact relating to the electronic ticket (s). Purchase contract: Between the “Buyer” and the “Seller” of an electronic ticket, a mutual purchase agreement is automatically established.


SALE OF ELECTRONIC TICKETS

Downloading tickets

As a Seller, you are empowered) to offer an electronic ticket for sale on the Platform, by downloading a file reproducing said electronic ticket. This file must be the original digital version, transmitted by the supplier of the electronic ticket, and the Seller must have received prior authorization to resell it. Scanned electronic tickets, photos or personalized or edited files are strictly prohibited. The Seller is, at any time, entitled to withdraw his offer, provided that the electronic ticket is not already reserved or sold. In order to dispel any doubt in this regard, once the electronic ticket is reserved for purchase by the Buyer, the Seller undertakes to sell it to the Buyer. Once the Buyer has made the payment, a final contract is automatically concluded between the Seller and the Buyer, without the Seller's prior approval.

Description of the electronic ticket

The Seller must fill in the information relating to the electronic ticket as completely and scrupulously as possible.
This information must include at least the name of the event, its price (including broadcast costs), as well as the Seller's bank account number. Also, the Seller undertakes to fill in the information relating to the electronic ticket (early bird ticket, precise entry times, child ticket, disabled access, member card required, etc.). The bank account must be opened in one of the countries listed here. The Seller defines the currency of the list from a supported currency. If these are electronic tickets assigning a seat or box number, these numbers must be clearly specified in the "description" or "seat information" field (if available). Passetonbillet reserves the right to modify the information appearing on the electronic ticket advertisement, if this is not correct or does not reflect the information entered on the original electronic ticket.

Fees and prices

The Seller decides on the sale price of each electronic ticket he offers on the Platform (the “Sale Price”), provided that this price does not exceed the sale price of said electronic ticket originally (issue costs included). In some countries there are restrictions (maximum price) on the offer and resale of electronic tickets. The Seller must imperatively respect any local legislation. For each electronic ticket that gave rise to the conclusion of a sales contract, the Seller is liable for an amount equivalent to 5% of the resale price, including VAT (hereinafter referred to as the “Service charges” ”) To Passetonbillet LTD. Payment of this amount will take the form of compensation and the Seller will therefore receive 95% of the resale price.
In the event that an electronic ticket is sold at more than 120% of the initial price (service fees included), Passetonbillet reserves the right to cancel the Sale or refund the amount exceeding 120% of the initial price (costs of service included). Passetonbillet decides when this happens and the Purchaser cannot claim any rights in this regard.
When the Seller has already been paid, he is obliged to reimburse Passetonbillet LTD the amount greater than 120% of the initial price (service charges included) in accordance with the Conditions of reimbursement.

V.A.T.

The V.A.T. pertaining to electronic tickets that the Seller resells via the Passetonbillet Platform must already have been paid for the original electronic ticket, before the Seller offers it for resale. Passetonbillet invoices the VAT on the transaction costs of the Buyer, as well as on the agency commission due by the Seller. Resold electronic tickets: The Seller receives an email accompanied by an attachment when the sale is made, and the resold electronic ticket is automatically withdrawn from the Platform. The Seller must ensure that the electronic ticket is clearly marked "Sold" on the Passetonbillet website. Consequently, the Seller undertakes to destroy any copy of the resold electronic ticket.

Payment to the Seller

The Seller receives an email accompanied by an attachment when the sale is made, and the resold electronic ticket is automatically withdrawn from the Platform. The Seller must ensure that the electronic ticket is clearly marked "Sold" on the Passetonbillet website. Consequently, the Seller undertakes to destroy any copy of the resold electronic ticket. Payment is made to the seller 24 hours after the departure date of the train for which the ticket is sold.

Compliance with EU law

Under EU law, Passetonbillet is required to go through the "Know your customer" ("KYC") procedure for Sellers on the Passetonbillet Platform. These KYC procedures are performed by our payment providers and are subject to privacy policies. Payment providers cross-check your information with their own databases and public databases to detect suspicious behavior. Following this analysis, you may be asked to provide them with additional identification documents. These must be original copies of your identification documents and cannot be altered (for example, watermark). The identification documents are deleted by the payment providers after verification.

Significant amounts

A Seller who, at any time, alone or with "Similar Sellers", has sold for more than 570.00 EUR of electronic tickets or sales offers for events that have not yet taken place ( below: "Uncertain value"), will only be paid later. It has been established that the electronic tickets proved to be valid and that the Purchaser was able to access the event. “Similar Sellers” means other Sellers who use the same personal information as the Seller.

Cancellation of the sale

Passetonbillet LTD has a particular interest in the proper performance of the contract between the Buyer and the Seller. The purchase contract also includes an irrevocable clause with a third party for the benefit of Passetonbillet LTD, allowing it to demand compliance with the contract, terminate the purchase contract or make it null and void, if the 'Buyer or Seller has not fulfilled the conditions set out in said Ticket Agreement.

Free tickets

The Seller is in no way authorized to sell an electronic ticket that he has obtained free of charge. This also includes invitations, electronic tickets won in contests or electronic tickets in the amount of € 0. Minimum selling price for an electronic ticket: The minimum selling price for an electronic ticket on Passetonbillet is € 5 (or equivalent to € 5 in other denominated currencies).


Buying electronic tickets

Fees, payment and delivery of electronic tickets

The Purchaser of an electronic ticket can pay online using the means of payment offered. The costs relating to the purchase of an electronic ticket amount to 5% of the sale price, and include transaction costs and VAT After the purchase, the electronic ticket can be downloaded directly from the Platform in the My Purchased Tickets section. Passetonbillet LTD sends by email, and this, as soon as possible, said electronic ticket in the form of a link to a file in PDF format. Therefore, a final contract between the Seller and the Buyer is established. Please note that due to the nature of the product, it is not possible to cancel the purchase or resale of an electronic ticket on Passetonbillet. Once the transaction is finalized, there is no withdrawal period for either the Buyer or the Seller. Payment to the seller is made 24 hours after the depature date of the train for which the ticket is sold. §

Modifications of the event

The Buyer undertakes to keep informed about the event for which he purchases an electronic ticket; he will have to verify himself whether the event is postponed, canceled or modified in any other way (facts to which it is collectively referred by the terms "Modified" or "Modification").
Passetonbillet LTD is not responsible for any damage affecting Passetonbillet users (Buyers and Sellers) following Changes in events.
In the event of the cancellation of an event, the organizer of the event usually offers "Compensation" to the person (natural or legal) who purchased the electronic tickets for that event directly (the Seller).
The Compensation offered by the organizer may differ from the amount paid by the Buyer for the electronic ticket on the Platform. Passetonbillet LTD is not responsible for the above-mentioned "price difference", whether with regard to the Buyer or the Seller.
The Seller is required to claim any Compensation offered by the organizer of the canceled event and to transfer it thereafter to Passetonbillet LTD on behalf of the Buyer, in accordance with the Refund Conditions. Compensation for a canceled event usually includes the original amount paid by the Electronic Ticket Vendor (excluding the ticket provider's service fees). This amount may be different from that paid by the Buyer on the Platform - deviation which may give a higher or lower price compared to the original amount. The organizer will generally pay the compensation to Passetonbillet LTD and the latter's service providers will transfer the compensation to the Buyer.
The Seller is required to claim any compensation offered by the organizer of the canceled event and to transfer it thereafter to Passetonbillet LTD on behalf of the Buyer. This amount is maximum that paid by the Buyer for the electronic ticket. Passetonbillet LTD will transfer this amount to the Buyer.
In some cases, the cancellation policy may differ from the processes listed above. The preferred solution goes in the direction of compensation paid to the Purchaser, the company Passetonbillet LTD locally is not responsible for price differences. ** If an event is postponed to another date or time and / or if the location of the event has changed, the Seller is not obliged to compensate the Buyer. In such situations. If the Buyer no longer wants his ticket, he can decide to sell it himself on the platform. Invalid electronic tickets

Whatever the resale platform used, there is always a risk that the electronic tickets purchased will not be valid. The risks relating to the validity of said electronic ticket and the costs incurred in this context are borne jointly by the Seller and the Buyer. The Seller is not authorized either to use said electronic ticket when the sale is finalized, or to sell said electronic ticket to a third party by any means whatsoever. The Purchaser, on the other hand, is only authorized to resell the electronic ticket using the Passetonbillet account used to purchase said electronic ticket. If it turns out that the electronic ticket is not valid, Passetonbillet LTD will endeavor to act as conciliator between the Buyer and the Seller, the latter being obliged to cooperate in order to find a satisfactory solution. If the latter refuses to cooperate, Passetonbillet LTD reserves the right to impose payment of costs on the Seller and to definitively block his account. All cases of invalid electronic tickets must be reported to Passetonbillet LTD. All disputes communicated through the various channels (e.g. via credit card companies) will only be handled if they are also communicated to Passetonbillet LTD locally. If the Seller refuses to cooperate, Passetonbillet LTD reserves the right to report on the Seller, to share the seller's personal information with the Buyer to file a complaint with the police and to (permanently) block his account. All cases of invalid electronic tickets must be reported to Passetonbillet LTD. All disputes communicated by the various channels (e.g. via credit card companies) will only be managed if they are also communicated to the company Passetonbillet LTD.

Conditions for reimbursement

in the event that the Seller has to reimburse Passetonbillet locally, it is required to do so in accordance with the Conditions for reimbursement. Seller's reimbursement to Passetonbillet LTD may be due to, but not limited to, the sale of invalid electronic tickets, the sale of electronic tickets at more than 120% of the original price (including service charges) or cancellation of the event. Passetonbillet LTD locally facilitates reimbursement to the extent of its capabilities. Reimbursement to Passetonbillet LTD must always be made using the methods offered by Passetonbillet LTD (arrangements between Buyer and Seller are made at their own risk). When the Seller has to reimburse Passetonbillet LTD for a canceled event, he is required to transfer the amount within 14 days of receipt of the Compensation by the organizer. The Purchaser cannot extend their rights for this item. In all other cases, the Seller is required to reimburse Passetonbillet LTD within 14 days of the issuance of the refund to the Buyer. If the refund has not been made within 14 days, Passetonbillet LTD reserves the right to appeal to a collection company. All additional costs arising from this collection company are the responsibility of the user.

Risks

The purchase of an electronic ticket through the Platform is not without risk. Passetonbillet LTD endeavors to carry out on its Platform only secure and satisfying transactions, but cannot guarantee that an electronic ticket purchased through its Platform is valid and necessarily guarantees you entry to the event selected.

Responsibility

Passetonbillet LTD can not be held responsible for damage caused by having used the service of the Platform or the Platform, unless such damage is intentional, or results from negligence or gross negligence.
